General Terms and Conditions of Sale

Article 1 – Purpose

1.1. These General Terms and Conditions of Sale (hereinafter referred to as the “GTC”) define the reciprocal rights and obligations of Sybillehomes SRL, whose registered office is located at Avenue Maurice 8, 1050 Ixelles, registered with the Crossroads Bank for Enterprises under number 0801.104.192, represented by Ms. Sybille van den Brule in her capacity as director (hereinafter referred to as “La Villa Maurice”), and any natural or legal person making a reservation or purchase from La Villa Maurice (hereinafter referred to as the “Client”).

1.2. La Villa Maurice operates a tourist accommodation business of the “furnished tourist accommodation” type, which includes providing a renovated house with several bedrooms, with additional services such as breakfast and cleaning.

1.3. These GTC govern all reservations made directly with La Villa Maurice.

1.5. These GTC prevail over any other general or specific terms not expressly accepted in writing by La Villa Maurice. Any deviation from these GTC must be agreed to in writing and remains exceptional.

1.6. By making a reservation, the Client acknowledges having read these GTC and accepts them without reservation.

Article 2 – Reservations and Occupancy

2.1. Reservations can be made directly with La Villa Maurice (website, email, telephone). Reservations made through third-party platforms (e.g., Booking.com, Airbnb) are governed, for their formation and payment, by the terms and conditions of those platforms. However, the rules of stay outlined herein (capacity, house rules, no smoking, etc.) apply to all stays, regardless of the booking method. The reservation is only confirmed after payment has been received within the deadlines set out in Article 4.1.

2.2. The maximum occupancy of the accommodation is set at nine (9) people, including infants, in accordance with applicable fire safety regulations. The Client is required to declare the exact number of people staying in the accommodation at the time of booking. Any unauthorized excess occupancy constitutes a serious breach of these GTC and may result in immediate exclusion without compensation or refund.

2.3. For security and insurance reasons, the Client must provide La Villa Maurice with the identity of each occupant, including minors, in advance via electronic means, by means of a copy of an identity card or any other official identification document. Access to the accommodation may be refused if this information is not fully and correctly provided. Minors may only stay in the presence of a legal guardian.

2.4. The Client agrees to comply with the accommodation's internal regulations, including the prohibition of any parties, noisy gatherings, or activities that disturb the neighborhood. Only persons registered in the reservation are authorized to access the premises. Any violation of these rules constitutes a serious breach of these GTC and may justify immediate termination of the contract without compensation or refund.

Article 3 – Prices and Taxes

3.1. The applicable nightly rates are those in effect on the day of the reservation and confirmed by La Villa Maurice. Prices are expressed in euros, inclusive of all taxes, unless otherwise stated.

3.2. For suites, the rates include the following:
• provision of the accommodation under the agreed conditions;
• cleaning at the beginning and end of the stay.
• tourist tax;
• bed linen and towels, changed once a week for long stays.
• breakfast.

3.3. La Villa Maurice reserves the right to modify its prices at any time, it being understood that reservations already confirmed will not be affected by any subsequent price changes.

Article 4 – Payment Terms

4.1. Unless expressly stated, the full price of the nightly stay must be paid at the time of booking and no later than twenty-four (24) hours before the scheduled arrival. If payment is not received within this timeframe, La Villa Maurice reserves the right to cancel the reservation without compensation to the Client.

4.2. Payments may be made through third-party booking platforms (such as Booking.com or Airbnb) or by means of a valid credit card (Visa, Mastercard). The Client must ensure that their card remains valid for the entire duration of the stay.

4.3. Upon booking, La Villa Maurice may require a credit card authorization (card imprint) as a guarantee of the reservation and as a security deposit covering any damage, theft, or incident attributable to the Client or occupants. This authorization does not result in immediate debit unless activated by La Villa Maurice in the event of a breach of contract. Photos of the furniture and objects in the house are available upon request.

Article 5 – Cancellation and Interruption of Stay

5.1. Cancellation conditions vary depending on the rate chosen by the Client at the time of booking. Some rates are cancellable and refundable until a deadline specified at the time of booking, while others are non-cancellable and non-refundable. These conditions are communicated to the Client before final confirmation.

5.2. In the event of a no-show by the Client on the scheduled arrival date, the full amount of the reserved stay is due and no refund will be issued.

5.3. In the event of early departure by the Client, for any reason whatsoever, the full price of the stay remains payable to La Villa Maurice, without any refund or credit being due.

5.4. La Villa Maurice reserves the right to cancel a reservation in the event of force majeure or unforeseen circumstances making it impossible to provide the accommodation (for example: fire, water damage, administrative decision, etc.). In this case, the Client may, as applicable, obtain a refund of sums already paid or agree to postpone their stay, without any other compensation being due.

Article 6 – Arrivals, Departures and Access

6.1. Arrivals (“check-in”) are possible between 3:00 p.m. and 10:00 p.m. on the agreed day. Departures (“check-out”) must take place between 8:00 a.m. and 11:00 a.m. Any departure after the deadline may result in the charge of an additional night.

6.2. In the event of a delayed arrival, the Client must inform La Villa Maurice as soon as possible. If prior notification is not received, and if arrival cannot be guaranteed within the agreed timeframe, access to the accommodation may be refused without compensation or refund.

6.3. Access to the accommodation can be independent, using a code provided to the Client before arrival. The Client is responsible for the use and safekeeping of this code. Loss or forgetting the code does not constitute an emergency justifying the intervention of La Villa Maurice, and no compensation may be claimed for this reason.

6.4. Staff are present on-site during certain hours (particularly in the morning and afternoon). The Client can contact La Villa Maurice by telephone between 7:00 a.m. and 8:00 p.m. for any questions regarding their stay. Outside of these hours, contact is limited to situations of extreme emergency.

6.5. Late departures are prohibited, except with the express agreement of La Villa Maurice.

Article 7 – House Rules

7.1. The Client agrees to use the accommodation responsibly and diligently, respecting public decency and the peace and quiet of the neighborhood. Any behavior contrary to public order or the rules of communal living may result in the immediate expulsion of the Client and all occupants, without compensation or refund.

7.2. The accommodation is strictly non-smoking in all indoor areas (cigarettes, e-cigarettes, shisha). In case of non-compliance, a fixed penalty of two hundred and fifty euros (€250.00) will be charged per room concerned. Ashtrays are provided on the terraces and in the garden.

7.3. Pets are not allowed in the accommodation. Any violation of this rule constitutes a serious breach of these Terms and Conditions.

7.4. The use of candles or any open flame device in the rooms and interior spaces is strictly prohibited for safety reasons.

Article 8 – Liability and Insurance

8.1. La Villa Maurice is bound by an obligation of due care in providing the accommodation and associated services. Its liability can only be invoked in the event of gross negligence or willful misconduct.

8.2. La Villa Maurice shall under no circumstances be held liable for any losses, thefts, forgotten items, or damages suffered by the Client or occupants within the accommodation, including in the common or private areas made available.

8.3. The Client is responsible for all material or immaterial damages caused by themselves or by occupants staying under their reservation, whether intentional or unintentional. La Villa Maurice is authorized to charge these costs using the credit card imprint provided as a guarantee or to claim additional compensation if necessary.

8.4. La Villa Maurice's liability, whether contractual, extra-contractual, or otherwise, is strictly limited to the total amount actually paid by the Client for the reservation or purchase in question. Under no circumstances may this liability exceed this amount, except in cases of gross negligence or willful misconduct.

8.5. In the event of damage resulting from La Villa Maurice's failure to perform a contractual obligation, compensation will primarily take the form of financial indemnity. In-kind compensation may only be demanded if expressly agreed upon by the parties and if reasonably feasible given the nature of the accommodation or property sold.

8.6. La Villa Maurice shall not be liable for any indirect or intangible damages suffered by the Client, including, but not limited to: loss of profits or revenue, damage to image or reputation, loss of business opportunity, or any moral injury.

8.7. Any expenses incurred by the Client to prevent imminent damage or limit the aggravation of existing damage will only be covered by La Villa Maurice with its prior written consent. Otherwise, these expenses will remain the Client's responsibility.

8.8. Only certain, actual, and proven damages will be eligible for compensation. Hypothetical, potential, or insufficiently established future damages are expressly excluded from any compensation.

8.9. For any situation not expressly governed by these GTC, the supplementary provisions of Book 6 of the Belgian Civil Code will apply.

Article 9 - Force Majeure and Termination

9.1. La Villa Maurice cannot be held liable for any delay in performance or inability to provide accommodation in the event of force majeure or circumstances beyond its control, including but not limited to: fire, flood, water damage, natural disaster, epidemic, strike, administrative decision, terrorist attack, unforeseen technical failure, or any other external event preventing the performance of the contract.

9.2. In the event of force majeure preventing the provision of accommodation, La Villa Maurice may cancel the reservation. In this case, the Client may choose to receive a full refund of any sums already paid or to postpone their stay to a later date, without any other compensation being due.

9.3. La Villa Maurice reserves the right to terminate the stay immediately, without compensation or refund, in the event of a serious or repeated breach by the Client of their contractual obligations or the house rules, including but not limited to:
• exceeding the authorized occupancy,
• the presence of unregistered persons,
• bringing animals into the property,
• the use of tobacco or devices prohibited in the accommodation,
• behavior contrary to public order or morality.

9.4. In this case, La Villa Maurice may use the security deposit (credit card imprint) to cover any damage, cleaning or repair costs, and take any additional action deemed necessary.

Article 10 – Intellectual Property

10.1. All elements relating to the hosting operated by La Villa Maurice, including but not limited to: texts, logos, photographs, illustrations, descriptions, graphic elements, videos, as well as the general presentation of the website and communication materials, are protected by intellectual property law and remain the exclusive property of La Villa Maurice or its successors in title.

10.2. The Client may not, under any circumstances, reproduce, represent, copy, modify, distribute, transmit, or exploit in any way whatsoever, in whole or in part, this content without the prior written authorization of La Villa Maurice. Any unauthorized use may be subject to civil and/or criminal prosecution in accordance with Book XI of the Belgian Code of Economic Law.

10.3. La Villa Maurice reserves the right to mention, for reference purposes, the name or trademarks of its partners, suppliers, or creators in its marketing communications, unless they expressly object in writing.

Article 11 – Personal Data

11.1. La Villa Maurice collects and processes personal data concerning the Client and the occupants of the accommodation in accordance with the General Data Protection Regulation (GDPR) and the Belgian law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data.

11.2. The data collected includes, in particular: surname, first name, contact details (address, email, telephone), copy of identity card or identification documents (including for children), payment and billing information, as well as any data necessary for the management of the stay, billing, and other related matters.

11.3. The main purposes of the processing are as follows:
• managing reservations and fulfilling the contract;
• complying with legal and regulatory obligations, particularly regarding safety and insurance;
• administrative and accounting management;
• communicating with the Client before, during, and after their stay;
• improving the services provided;
• sending commercial and promotional information, subject to the Client's prior consent.

11.4. Personal data is retained for the period necessary to achieve the aforementioned purposes and in accordance with applicable legal retention periods.

11.5. Data is only disclosed to those strictly necessary for the performance of the contract or legal obligations (for example, technical service providers, accountants, competent administrative authorities). La Villa Maurice does not transfer data outside the European Economic Area, except when data is hosted on servers that offer a level of protection recognized as adequate or with appropriate safeguards.

11.6. The Client has the following rights:
• right of access to their data;
• right to rectification;
• right to erasure (“right to be forgotten”);
• right to restriction of processing;
• right to data portability;
• right to object, in particular to processing for marketing purposes.

11.7. To exercise these rights or ask any questions relating to the processing of their data, the Client may contact La Villa Maurice.

11.8. In the event of a violation of their rights, the Client may lodge a complaint with the Data Protection Authority (DPA), Rue de la Presse 35, 1000 Brussels (www.autoriteprotectiondonnees.be).

11.9. La Villa Maurice implements all appropriate technical and organizational measures to ensure the security, confidentiality, and integrity of the personal data processed.

Article 12 – Miscellaneous

12.1. If one or more provisions of these GTC are deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

12.2. The failure of La Villa Maurice to enforce any provision of these GTC at any time shall not be construed as a waiver of its right to enforce such provision subsequently.

12.3. La Villa Maurice is authorized to use subcontractors to perform all or part of its contractual obligations. In this case, La Villa Maurice remains responsible to the Client for the proper performance of the services.

12.4. The contract between La Villa Maurice and the Client has a fixed term, limited to the dates of the reserved stay, unless otherwise agreed between the parties.

Article 13 – Governing Law and Jurisdiction

13.1. These General Terms and Conditions, as well as any contract concluded between La Villa Maurice and the Client, are governed by Belgian law.

13.2. Any dispute relating to their validity, interpretation, or performance shall be subject to the exclusive jurisdiction of the French-speaking courts of the judicial district of Brussels.

13.3. Before initiating any legal action, the parties agree to seek an amicable solution in good faith.
